NEW BETHLEHEM, Pa. (EYT) – Two individuals are facing drug, endangering the welfare of children, and related charges stemming from an incident that occurred on Broad Street, in New Bethlehem Borough.

According to court records, New Bethlehem Borough Police Department filed criminal charges against 27-year-old Sara Elizabeth Duttry and 31-year-old Joe F. Provost, both of DuBois.

According to a criminal complaint, around 9:00 p.m. on May 14, Officer Peck, of New Bethlehem Borough Police Department, received a call from a known individual stating that an unknown male was in a restroom at a convenience store on Broad Street for almost an hour. The caller also stated that there was a female passed out in the passenger’s seat of the above mentioned male’s vehicle. Additionally, there was an infant in a car seat in back seat of the vehicle.

The complaint states that when Officer Peck arrived at the 600 Broad Street convenience store, the male was starting to back the vehicle up. She asked if everything was okay, and the driver — Joe F. Provost — stated “I was just taking a #2.” When Officer Peck “made eye contact with Provost and the passenger — Sara Elizabeth Duttry — she noticed they both had constricted pupils and very pale skin, as if both were sick….and, both were shaking very badly.”

There was also an 11-month old female in the back seat.

Officer Peck asked both individuals why their pupils were constricted. Provost stated that “he currently had a Fetanyl patch on and that he was on Percocet. He stated that he was not under any influence of Heroin or Opiates.” Duttry stated that she was very car sick, the complaint indicates.

Duttry, the owner of the vehicle, gave Officer Peck permission to search it. When Officer Peck asked Duttry “if there was anything in the vehicle that she should know about, Duttry denied multiple times that there was anything and then stated there might be a needle in there,” according to the complaint.

Officers Peck and Spencer searched the vehicle and found “a gray makeup bag on the floor where Duttry was sitting that contained three needles, two spoons, six empty stamp bags (known for packaging Heroin) that were marked “Knockout,” and one blue pill grinder, the complaint continues.

Dutty allegedly stated those were hers, the complaint states.

CYS Clarion was notified, and they stated the infant could be placed with a family member, the complaint indicates.

Based on her investigation, on May 23, Officer Peck filed criminal complaints against Duttry and Provost.

Duttry faces a preliminary arraignment at 10:00 a.m. on June 8 in front of Magisterial District Judge Jeffrey C. Miller on the following charges:

• Endangering Welfare of Children — Parent/Guardian/Other Commits Offense, Misdemeanor 1 (two counts)
• Use/Possession Of Drug Paraphernalia (12 counts)
• Recklessly Endangering Another Person, Misdemeanor 2

A preliminary arraignment for Provost has been scheduled for 10:15 a.m. on June 8 with Judge Miller presiding.

He faces the following charges:

• DUI: Controlled Substance — Impaired Ability — 1st Offense, Misdemeanor 1
• Endangering Welfare of Children — Parent/Guardian/Other Commits Offense, Misdemeanor 1
• Recklessly Endangering Another Person, Misdemeanor 2
• Use/Possession Of Drug Paraphernalia, Misdemeanor (eight counts)
