Clarion Man Allegedly Conspires to Steal Firearms from Grandfather

CLARION, Pa. (EYT) — A Clarion man who is awaiting court proceedings for allegedly dealing Heroin in Clarion Borough is now facing burglary charges.

Online court documents indicate that criminal charges were filed against 38-year-old Justin C. Stark, of Clarion.

According to a criminal complaint, Clarion County Chief Detective/CNET member William H. Peck was “contacted by a confidential informant who stated that Justin ‘Bud’ Stark was inquiring…if anyone would be interested in buying four guns for approximately $700.00.”

The complaint states that Officer Peck was aware that CNET had pending criminal charges against Stark for Conspiracy to Deliver Heroin and that Stark had an active arrest warrant issued by the Pennsylvania State Parole.

It was noted that Stark is a convicted felon and prohibited from possessing firearms, the complaint continues.

Officer Peck agreed to a “controlled purchase” of the guns through the informant and attempted to gain more details on the guns, according to the complaint.

The complaint indicates that around 7:20 p.m. on July 30, Officer Peck met with the informant; Stark was contacted, and the informant told him that “the buyer needed more information on the guns.”

According to the complaint, “Stark provided the following information:

1. Mossburg 500 12 Gauge Pump shotgun

2. Ithaca Double Barrel, Double Trigger (Stark stated, ‘it’s old and probably worth some money.’)

3. 7 MM Rifle Ruger, stainless steel barrel, composite stock, bolt action, 3×9 scope (Stark stated, ‘he believed it was 3×9 but not sure — he hasn’t seen it for awhile.’)

Stark stated he would sell all three for $700.00. The informant questioned Stark stating that (he/she) believed there was a fourth gun — 22 mag. Stark stated ‘he did not want to tell (him/her) that until he knew for sure it was there.'”

According to the complaint, “The informant asked Stark to send some pictures of the guns, and Stark replied he could not until he got there. When the informant asked Stark how (he/she) was going to get the guns from him. Stark replied, ‘You’re gonna have to take me.’ Stark made the comment, ‘When it gets somewhere dark, I will run down and get them.'”

The complaint states that in the presence of Officer Peck, the informant called Stark around 9:01 p.m. on July 30. The informant told Stark that (he/she) did not want to go to jail if Stark had to smash into somewhere to get the guns. Stark then replied, ‘Just drop me off, you drive down the road, I will walk in and get them, down Fourth Avenue.’ Stark stated that it was his grandparents’ house, and to drop (him) off and (he) will get them and call. Then, ‘drive down the road, have the seat flipped down, and (he) will throw the guns in and jump in and take off.'”

“The informant then asked Stark, ‘so, it’s your grandparents’ house, and Stark replied, ‘Yeah, there is no one home.'”

“Before the call ended, Stark asked the informant to get him a pair of dark sweatpants and a dark long sleeve shirt that he can wear,” the complaint states.

Officer Peck was “aware of Stark’s grandfather who resides on S. Fourth Avenue in Clarion Township,” the complaint continues.

The informant also told Officer Peck that Stark’s location was near the 700 Block of South Street. Officer Peck contacted other CNET members, Clarion Borough Police Department, and Pennsylvania State Police in an attempt to intercept Stark on his way to commit the burglary/theft and arrest him on the outstanding Pennsylvania State Parole warrant and the pending delivery of heroin charges,” according to the complaint.

Around 10:40 p.m., Officer Peck and Trooper Craddock of PSP Clarion met with the informant. The informant contacted Stark and told him that (he/she) would pick him up in the 700 Block of South Street in 15 minutes.

Officer Peck and Pennsylvania State Trooper Craddock followed the informant to the 700 Block of South Street, and the informant parked in front of an apartment building. Stark got into the front passenger seat, and the informant drove Stark west on South Street toward Fourth Avenue. Officer Peck put in place an arrest plan as follows: When the informant’s vehicle turned left onto Fourth Avenue, Pennsylvania State Police marked units and Clarion Borough Police would stop the car and make the arrest of Stark, the complaint states.

Around 11:15 p.m., the vehicle turned left onto S. Fourth Avenue. Stark was in the front passenger’s seat and was taken into custody without incident. “Under the front passenger seat was an eye glass-type ‘kit’ that contained five needles, empty stamp bags of heroin, spoon, and numerous Q-Tips.” Officer Peck seized the “drug kit” as evidence, the complaint indicates.

Stark was transported to the Clarion Borough Police Department. He was detained in the Clarion County Jail on a parole detainer.

On August 3, Officer Peck obtained information that “Stark had actually sold a gun to a known person in Beaver Township, just days prior to his arrest.” This case is being handled by State Police.

Officer Peck and Trooper Hotchkiss, of PSP Clarion, made contact with a family member of the victim who said that the victim did have several guns at his residence that were in a gun case.

During the investigation, it was learned that one gun was missing from the victim’s gun cabinet — a 6mm Rifle.

The description of the guns that Stark intended to sell matched the description of the guns at the victim’s house.

Based on his investigation, Officer Peck filed a criminal complaint against Stark in District Judge Duane L. Quinn’s office.

A preliminary arraignment is scheduled for 1:15 p.m. on August 29, on the following charges:

  • Criminal Attempt — Criminal Trespass — Enter Structure, Felony 3
  • Criminal Attempt — Theft By Unlaw Taking — Movable Property, Felony 3
