Cases Against Two Locals Waived for Court

CLARION CO., Pa. (EYT) — Drug charges against two local individuals have been waived for court.

Criminal charges against 24-year-old Joseph Adam Brosius, of Hawthorn, and 22-year-old Elizabeth Carol Ganci, of Tionesta, have been transferred to the Clarion County Court of Common Pleas.

Although Brosius is facing multiple offenses that include felony charges for possession of red phosphorous and conspiracy, misdemeanor charges for drug possession and drug paraphernalia, and other summary charges, all of Ganci’s charges were withdrawn except for one felony count of possession of red phosphorus.

Details of Highland Township Arrest

According to a previously published article on exploreClarion.com, around 7:21 p.m. on January 20, Trooper Allison, of Clarion-based State Police, was traveling north on Miola Road in a marked patrol car. A Dodge Caravan was in front of his vehicle, and upon checking the registration on the mobile computer, it was discovered the registration belonged to a Chevrolet.

The complaint states that Trooper Allison conducted a traffic stop near McCleary Road on the Dodge Caravan. Upon approaching the vehicle, Trooper Allison could smell a slight odor of burnt marijuana emanating from the vehicle. He informed the driver of the vehicle of the reason for the traffic stop and asked for his driver’s license. When Trooper Allison asked the driver why the plate came back for a Chevy, “he related that he just purchased the vehicle from a man in New Bethlehem, and the plate was with it.”

The driver produced a PA operator’s license identifying him as Joseph Adam Brosius. Brosius could not produce any registration, insurance, or proof of his ownership of the vehicle. A right front passenger in the vehicle was identified as Elizabeth Carol Ganci, of Tionesta, according to the complaint.

Trooper Allison asked Brosius if there was anything in the car that he needed to know about, and Brosius stated “a bunch of garbage and clothes.” Brosius consented to a search of the vehicle, the complaint continues.

While conducting a safety search of Ganci’s coat, an orange elastic band was retrieved from her left coat pocket. Trooper Allison recognized “the orange elastic band as a drug paraphernalia used to tie on one’s arm for the purpose of injecting a needle,” the complaint indicates.

During a search of the vehicle, the following items were discovered:

– A black and silver box was found in the center console containing five plastic baggies of suspected methamphetamine (NIK tested);
– One small vial of methamphetamine;
– Two lithium batteries;
– Multiple used and unused needles;
– Two stamp bags of heroin;
– Two metal spoons labeled Joey and Baby;
– A metal container of syringe water.

Brosius was charged with the following offenses:

Charges Waived for Court on March 14, 2017

All of Brosius’ charges were waived for court.

A felony charge of Possession Red Phosphorus, etc. w/Intent to Manufacture Controlled Substance against Ganci has been waived for court. All other charges have been withdrawn.

Details of Paint Township Arrest

According to a criminal complaint, while on stationary patrol on Saturday, February 18, on Interstate 80 at the westbound 61.4 mile marker, Trooper Allison, of Clarion-based State Police, initiated a traffic stop on Joseph Adam Brosius who was driving a red Dodge Caravan. Elizabeth Carol Ganci was in the front passenger seat.

The complaint states that Allison discovered felony drug warrants on both from an arrest on January 20. As Allison approached the van, he could smell marijuana, and after searching Brosius, found a roll of currency that totaled $669.00 in his front pocket.

Both individuals were taken into custody. Brosius asked that the van be pulled off the road, rather than being towed. As Trooper Allison entered the vehicle to pull it off the roadway, he discovered two syringes, according to the complaint.

A search warrant was obtained for the van, and two spoons, a hypodermic needle, two vials, one plastic bag containing white residue and a plastic straw were discovered in a black safe, the complaint said.

During the search, police also found a new container of plastic baggies, cleaner, four metal spoons with residue, a plastic container of rubber bands, a Walmart receipt for $11.77 for a cold pack, starter fluid, a spoon, and a Mason jar with residue.

In addition, two heroin stamp bags and a plastic bag containing methamphetamine were found, the complaint said.

All charges against Ganci have been withdrawn.

Status of Both Cases

Unable to post $50,000.00 monetary bail for each case, Brosius remains in Clarion County Jail.

Unable to post $50,000.00 monetary bail for the Highland Township arrest, Ganci remains in the Clarion County Jail.

The cases are currently working their way through the court system.
