Cases Move Forward Against Venango County Couple Accused of Child Sexual Assault

VENANGO CO., Pa. (EYT) – Jury selection will begin on Monday, April 3, for an Oil City man accused of rape and related charges involving two young girls.

According to online court documents, 34-year-old David William Waters, Jr., of Oil City, is facing the following charges:

2008 Child Rape Case

- Rape of Child, Felony 1
- Statutory Sexual Assault, Felony 2
- Incest, Felony 2
- Indecent Assault Person Less than 13 Years of Age, Felony 3
- Endangering Welfare of Children – Parent/Guardian/Other Commits Offense, Felony 3
- Corruption Of Minors, Misdemeanor 1

2013 Child Rape Case

- Criminal Attempt – Rape of Child, Felony 1
- Criminal Attempt – Statutory Sexual Assault: 11 Years Older, Felony 1
- Photograph/Film/Depict On Computer Sex Act of Child, Felony 2
- Indecent Assault Person Less than 13 Years of Age, Felony 3
- Indecent Assault Person Less than 13 Years of Age, Felony 3
- Endangering Welfare of Children – Parent/Guardian/Other Commits Offense, Felony 3

According to court documents, on March 3, 2017, Judge Oliver Lobaugh granted Waters’ defense attorney, Eric Alan Padin, access to Venango County Children and Youth Services records.

Unable to post $250,000.00 monetary bail for each case, Waters remains lodged in the Venango County Jail.

Details of the 2008 and 2013 Cases

2008 Alleged Rape Incident

According to a criminal complaint, on April 13, 2016, Oil City Police interviewed a victim who stated that in 2008 David Waters was at her house and he asked her to come upstairs; he allegedly took her to the bathroom and touched her inappropriately. He then allegedly took her to the bedroom and performed a sexual act on her. The victim said that she believed that she was eight years old at the time.

2013 Alleged Rape Incident

According to a criminal complaint, on February 7, 2016, Oil City Police received information that David Waters allegedly had sexual contact with a child who was four years old at the time of the incident.

The child was the subject of a forensic interview on February 22, 2016, by Venango County Children and Youth agency.

The complaint states that the child said Waters took her to the bathroom and touched her inappropriately. The child also said that Waters took pictures of her naked body with his cell phone.

Waters allegedly warned her not to say anything to anyone or he would spank her, the complaint continues.

On April 23, 2016, police discovered that Waters had allegedly recorded a sex act on his cell phone with the same child, according to the complaint.

On September 16, 2016, police interviewed a known woman who was allegedly shown a video of Waters performing a sex act. The woman said she confronted Waters, and he allegedly told her that he was “watching a movie that starred Angelina Jolie and he began to get excited,” and he performed a sex act on the child, the complaint continues.

Cases Against Chastity Bellin

Bellin Allegedly Shows Sex Video/Endangers Children

During the investigation of sex crimes against David Waters, Jr., a known woman was interviewed who stated that sometime in February of 2013, 34-year-old Chasity Lynn Bellin, of Oil City, showed her a video that depicted Waters (Bellini’s boyfriend) performing a sex act on a female minor, according to a criminal complaint.

On September 19, 2016, a representative of Venango County Children and Youth Services stated that on many occasions since February of 2013, Bellin allowed other children to stay at her residence or be supervised by David Waters, Jr., knowing that Waters had performed sexual acts on children in the past, the complaint indicates.

Based on the investigation, charges were filed against Bellin in District Judge Andrew F. Fish’s office.

She was arraigned at 1:25 p.m. on September 20, on the following charges:

- Dissemination Photo/Film of Child Sex Acts, Felony 3
- Endangering Welfare of Children – Parent/Guardian/Other Commits Offense, Felony 3

Bellin Allegedly Sells Narcotics

According to a criminal complaint, on September 20, 2016, officers from the Oil City Police Department went to 306 Wilson Avenue, second-floor apartment to serve a warrant for the above described case.

The complaint states that upon arrival, a known man was coming out of the apartment, and as he saw Chief Wenner, he stuffed something into his pocket. Chief Wenner asked him what it was, and he said “nothing.”

The known man was detained. It was learned that he had a bottle with a couple of pills in his pocket and his billfold, the complaint continues.

The officer then proceeded up the outside stairs to Bellin’s apartment with a warrant for her arrest; she was taken into custody. While police were there, due to the deplorable condition of the house, the Code and Zoning Officers were called and checked the second-floor apartment.

The known man was interviewed, and it was discovered that Bellin “sold (the known man) two BMG Subutex pills for $75.00, a schedule III narcotic drug,” the complaint states.

During an interview, Bellin allegedly admitted to selling the Subutex to the known man.

Based on the investigation, charges were filed against Bellin in District Judge Patrick E. Lowrey’s office.

She was arraigned at 3:01 p.m. on September 20, on the following charges:

- Conspiracy – Manufacture, Delivery, or Possession with Intent to Manufacture or Deliver, Felony
- Criminal Use of Communication Facility, Felony 3
- Manufacture, Delivery, or Possession with Intent to Manufacture or Deliver, Felony

According to online court documents, Bellin is currently free on $50,000.00 unsecured bail for the child sex case and $25,000.00 unsecured bail on the drug case.

Court documents indicate Bellin is scheduled for plea court at 9:00 a.m. on Monday, March 20, on both cases.
