JEFFERSON CO., Pa. (EYT) — A Jefferson County man is facing charges of resisting arrest following a domestic disturbance that occurred last week in Beaver Township, Jefferson County.
According to court documents, Punxsutawney-based State Police filed criminal charges against 29-year-old Andrew James Birch, of Summerville.
He was arraigned on February 9 on the following charges:
- Resisting Arrest, Misdemeanor 2
- Harassment, Summary
Unable to post $15,000.00 bail, Birch was lodged in the Jefferson County Jail.
His bail was posted by a professional bondsman on February 12.
His preliminary hearing is scheduled for 3:45 p.m. on Thursday, March 15, with District Magistrate Gregory M. Bazylak presiding.
According to a criminal complaint, around 5:25 p.m. on February 8, Trooper David Powell was dispatched to a residence on Heathville Ohl Road in Beaver Township, Jefferson County.
Birch’s mother said that Birch arrived at the house intoxicated and got involved in an argument with her because he thought she was killing his dog. He began to smash items inside the residence before being subdued by his brother and stepfather, the complaint states.
When Trooper. Powell arrived, he tried to take Birch into custody, but Birch was spitting and kicking and wouldn’t comply with verbal instructions to calm down. He shouted, “I’ll kick your (expletive),” according to the complaint.
Birch was subdued with a Taser and then taken into custody without further incident.
