Preliminary Hearing Set for Man Accused of Raping Woman While She Was Unconscious

CLARION TWP., Pa. (EYT) — The preliminary hearing has been scheduled for a 23-year-old man who allegedly raped a woman while she was unconscious.

According to court documents, 23-year-old Nicholas Jendrzejewski, of Pittsburgh, faces a preliminary hearing at 10:30 a.m. on Tuesday, March 13, in Magisterial District Judge Duane L. Quinn’s office on the following charges:

– Rape Unconscious Victim, Felony 1
– Sexual Assault, Felony 2
– Aggravated Indecent Assault W/O Consent, Felony 2
– Aggravated Indecent Assault – Complainant is Unconscious or Unaware that Penetration is Occurring, Felony 2
– Indecent Assault-W/O Consent Of Other, Misdemeanor 2
– Indecent Assault Person Unconscious, Misdemeanor 1

The charges stem from an incident that occurred on November 11, 2017.

Jendrzejewski is free on $50,000.00 monetary bail (10%).

Details of the case:

According to a criminal complaint, Nicholas Jendrzejewski “engaged in sexual intercourse with the victim while the victim was unconscious at (a housing complex) in Clarion Township.”

The victim told Officer White, of the Clarion University Police, that she and Jendrzejewski had been friends in the past. She and Jendrzejewski were at a local bar, and Jendrzejewski used her phone to call a friend to pick them up. She also stated that she was “very intoxicated,” the complaint states.

The victim stated that she remembers “waking up,” and Jendrzejewski was on top of her. She indicated that she was still very intoxicated and “was unable to tell Jendrzejewski to stop or to get off of her.”

Jendrzejewski left the apartment around 10:00 a.m., and then he returned around 11:00 a.m. and asked the victim if they were “okay.” The victim stated that she asked Jendrzejewski “why would you do that with knowing how drunk I was?”

The victim stated that Jendrzejewski said “sorry” and then laughed.

The victim provided Officer White with text messages between her and Jendrzejewski. At one point, the victim stated to Jendrzejewski, “Like, you honestly know that you raped me?” And, Jendrzejewski responded, “Yea, I do,” according to the complaint.
