Former Venus Man Acquitted in Erie County Homicide to Serve Time on Drugs, Gun Charges

ERIE, Pa. (EYT) — A former Venango County man who was found not guilty last month of an Erie County homicide and other charges was sentenced to serve time in state prison on drug and gun charges.

According to online court documents, on Friday, April 20, Erie County Judge John J. Mead handed down the following sentence to 23-year-old Devin Stevenson, formerly of Venus:

– Five years probation for Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony;
– A minimum of 1-1/2 years and a maximum of 4 years for Firearms Not To Be Carried W/O License, Felony 3; and
– One-year probation for Use/Possession Of Drug Paraphernalia (to be served concurrently with the five-year probation).

The probation sentence will be served consecutively to the prison sentence.

Stevenson will receive credit for 235 days time served.

The charges stemmed from a March 20, 2015 incident in which Stevenson shot two men during a botched drug deal.

Stevenson was found not guilty in the March 2015 fatal shooting of O’Shae Imes in Edinboro.

However, he was found guilty of possession with intent to deliver and carrying a firearm without a license.

Details of the March 2015 incident:

According to police, Stevenson shot O’Shae Imes and Andrew Baker in the March 20, 2015 confrontation.

Stevenson maintained Imes and Baker tried to rob him. Imes wore a black mask, a hoodie and carried a pellet gun. Stevenson, thinking the gun was real, told the jury on Thursday that Imes pointed the pellet gun at him.

Remembering that night, Stevenson said, “I’m thinking he’s gonna actually shoot me now.”

According to Erie County District Attorney Jack Daneri, the homicide charge was filed after his office received the autopsy results from Rochester, N.Y.

Stevenson was accused of fatally shooting Imes at an apartment in Edinboro.

Edinboro Police say Stevenson was there to sell drugs to Imes and Baker, who was also shot, according to a published article on GoErie.com.

Stevenson was a second-year student at Edinboro at the time of the shooting incident. He was suspended after the incident and banned from the Edinboro campus.

Imes and Baker were also students at Edinboro University.

Baker Pleads Guilty to Robbery

On April 4, 2018, 23-year-old Andrew Baker pleaded guilty to a first-degree felony count of Robbery-Inflict Threat Imminent Bodily Injury for setting up the robbery of Stevenson.

His sentencing is scheduled for 8:45 a.m. on June 11 with Erie County Judge John Garhart.
