Clarion Woman Sentenced to Probation on Drug Charges

CLARION, Pa. (EYT) — A Clarion woman has been sentenced to probation for drug paraphernalia found in her residence.

According to court documents, on May 9, 50-year-old Donna Marie Planke, of Clarion, was sentenced in Clarion County Court of Common Pleas to six months of county probation.

Clarion County President Judge James G. Arner also ordered Planke to the following conditions:

– Pay the costs of prosecution and supervision fee;
– Not consume any alcoholic beverages or illegal drugs;
– Pay $100.00 to the Clerk of Courts pursuant to Act 198; and
– Perform 25 hours of community service.

Planke pleaded guilty on April 11 to one misdemeanor count of use/possession of drug paraphernalia.

The following charges were dismissed as a result of the plea agreement:

– Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony (six counts)
– Conspiracy – Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony (six counts)
– Possessing phenylpropanolamine, etc., or a precursor substance with intent to unlawfully manufacture, Felony (six counts)
– Operating a methamphetamine lab, Felony 2 (six counts)
– Deposits, stores, disposes chemical waste, Felony 3 (22 counts)

Details of the case:

According to a criminal complaint, around 12:52 p.m. on September 1, CNET member and Clarion County Chief Detective William H. Peck and members of Clarion-based State Police arrived at 120 CAA Lane Lot# B in Clarion to serve an arrest warrant on Michael E. Stewart for Manufacturing Methamphetamine.

Upon arrival, Trooper Allison, of PSP Clarion, made contact with Stewart in the backyard of his trailer. Stewart was detained.

The complaint states that Stewart signed a consent to search form, and PSP members along with Detective Peck entered the residence that was also occupied by Stewart’s girlfriend, Donna M. Planke.

Trooper Allison located two one-pot methamphetamine bottles in the refrigerator’s freezer, the complaint indicates.

Chief Detective Peck viewed a funnel on the top shelf just inside the rear door of the trailer. Also located was a bottle of Liquid Lightning drain cleaner in the bathroom. At this point, the PA State Police Meth Lab Team was contacted, according to the complaint.

Chief Detective Peck talked to both Stewart and Planke about the one-pots in the freezer.

Stewart stated that “they went away last week, and some friends stayed at his residence, and they must have cooked meth and put the bottles there,” the complaint states.

He allegedly admitted that he uses meth but doesn’t cook it, the complaint indicates.

He also allegedly admitted to purchasing Sudafed pills earlier on September 1, the complaint continues.

Planke stated that “the one-pots had been in the freezer for approximately a week and all she knows is that Stewart told her not to touch them,” according to the complaint.

Planke denied being a meth user.

She allegedly told Chief Detective Peck that it had been a couple of weeks since she purchased any Sudafed pills, but it wasn’t used for making meth, according to the complaint.
