Charges Waived for Court Against Clarion Co. Jail Inmate Accused of Assaulting Another Prisoner

PAINT TWP., Pa. (EYT) — Charges against an inmate who allegedly assaulted another prisoner at the Clarion County Jail have been waived for court.

According to court documents, on May 15, charges against 28-year-old Joshua James Fair, of Oil City — currently lodged in the Clarion County Jail, were transferred to the Clarion County Court of Common Pleas.

Fair faces one second-degree misdemeanor charge of Simple Assault stemming from an incident that occurred in February.

Details of the assault case:

According to a criminal complaint, Clarion County Detective William Peck was advised by Clarion County Corrections Deputy Warden Sprankle of an assault that occurred on February 4, 2018, between two inmates — Joshua J. Fair and a known man.

Sprankle advised that Fair walked up to the known inmate while the inmate was seated in a chair and punched him in the face. The inmate obtained a cut above his left eye. He was transported to Clarion Hospital for medical attention that required four stitches.

A copy of the report, pictures of the injury, and a video of the incident were provided to Officer Peck.

It was learned during the investigation that Fair stated he struck the known inmate because the known inmate was making comments about hitting women, the complaint states.

According to the complaint, Officer Peck requested that the court require Fair to answer to the charge of Simple Assault and require him to pay for the medical costs associated with the incident.

Fair was arraigned at 11:30 a.m. on May 11 in front of Magisterial District Judge Timothy P. Schill.

Bail was set at $5,000.00 monetary.

Fair is currently awaiting sentencing on an unrelated drug-related case.
