VENANGO CO., Pa. (EYT) — A Venango County man was found guilty of homicide by vehicle while DUI and related charges on Tuesday.

According to court documents, on Tuesday, October 16, 34-year-old Raymond Norman Herold, of Franklin, was found guilty on the following seven counts by a jury trial on a case involving the death of a Franklin woman in June of 2016:

– Homicide By Vehicle While Driving Under The Influence, Felony 2
– DUI: General Impairment/Incompetent of Driving Safely – 1st Offense, Misdemeanor
– DUI: General Impairment (BAC .08 – .10) 1st Offense, Misdemeanor
– Disregard Traffic Lane (Single), Summary
– Driving at Safe Speed, Summary
– Careless Driving, Summary
– Failure to use safety belt – driver and front seat occupant, Summary

Herold received a not guilty verdict on a charge of Homicide By Vehicle, a third-degree felony.

He is currently free after posting bail on April 19, 2018.

His sentencing is scheduled for December 10, 2018.

Herold could face up to ten years in prison.

Details of the Case:

According to a criminal complaint, a one-vehicle crash occurred when Raymond Norman Herold under-compensated while attempting to negotiate a turn, causing his vehicle to travel off Sugarcreek Drive. Once off the roadway, the vehicle struck a utility pole with the driver’s side door. The vehicle then flipped over and spun 180 degrees and struck a small tree before coming to rest on its roof facing the opposite way that it had struck the utility pole.

The complaint states that the vehicle owner, Christina Joan Hoover, of Franklin, was sitting in the front passenger seat and was partially ejected from the vehicle resulting in fatal injuries. She was pronounced dead at the scene.

It was learned through an interview with the attending paramedic that Herold had lacerations to the left side of his face, and STAT MedEvac 6 flew him to UPMC Presbyterian Hospital in Pittsburgh.

Pittsburgh-based State Police interviewed Herold at UPMC, and Herold stated that Hoover was driving the vehicle, the complaint states.

Herold said that he did not have a seat belt on and neither did Hoover.

During an interview with Trooper Bingman, of PSP Franklin, Herold stated that he wasn’t driving, the complaint indicates.

Herold agreed to submit a DNA sample during the interview with Trooper Bingman.

According to the complaint, the lab report from the Forensic DNA Division indicates that Herold’s DNA was located on the driver’s side front airbag, driver’s side front knee bolster, driver’s side seat airbag, and the passenger’s side front airbag.

A witness at the local bar at the night of the crash observed Hoover getting into the passenger seat of her car and Herold getting into the driver’s seat.

An interview with a witness at the crash scene reported that Herold allegedly said to him, “Oh (expletive) I killed someone,” the complaint states.

Herold’s blood test was performed at 1:30 a.m. on June 6, 2016. His BAC (Blood Alcohol Content) was 0.097%, according to the complaint.
