Man Accused of Sexually Assaulting Victim While She Was Asleep in Clarion Twp. Apt. Due in Court Tomorrow

CLARION TWP., Pa. (EYT) — A 23-year-old man who allegedly sexually assaulted a victim while she was asleep at an apartment in Clarion Township is due in court tomorrow.

According to court documents, 23-year-old John Phillip Semmer, of Pittsburgh, is scheduled to stand for a preliminary hearing in front of Magisterial District Judge Duane L. Quinn at 1:45 p.m. on Tuesday, December 11.

He faces the following charges:

– Aggravated Indecent Assault W/O Consent, Felony 2
– Aggravated Indecent Assault — Complainant is Unconscious or Unaware that Penetration is Occurring, Felony 2
– Indecent Assault-W/O Consent Of Other, Misdemeanor 2

Semmer is currently free on $25,000.00 unsecured bail.

Case details:

According to a criminal complaint, on April 30, Corporal White, of the Clarion University Police Department, interviewed a victim who stated that she had been sexually assaulted at her apartment on April 28, 2018.

She stated that on April 27, around 11:00 p.m., she, John Semmer, and two of her roommates were in the apartment, drinking and playing board games.

Around 3:30 a.m. on April 28, she went to her bedroom and started school work. She said that Semmer came into her room and talked to her. In the past, Semmer had come to her bedroom to talk to her, and she didn’t have a problem with him.

At one point, Semmer’s girlfriend had texted him and asked him if he was going to go to bed. Semmer left and went to his girlfriend’s room, and the victim continued to study in her room.

Around 6:30 a.m. on April 28, the victim stated that Semmer stopped at her room and stated that he was going back to his apartment to do some laundry and asked if she wanted to go. She declined.

The victim stated that she got into the shower, and when she came out, Semmer was sitting at her computer. She had lain down on her bed and started to study.

She said that she had fallen asleep. When she awakened, Semmer was laying on top of her, and he was inappropriately touching her, according to the complaint.

She stated that she asked Semmer what he was doing, and he replied that “she wanted it.” She said to Semmer that he had a girlfriend, and Semmer replied, “Well, you wanted this,” according to the complaint.

The victim told Semmer that she was going to be sick and went to her bathroom in her bedroom and shut the door behind her. Semmer then walked into the bathroom and asked her if she needed anything, and the victim replied, “No.”

The victim stated that when she left the bathroom, Semmer was in her room. and he asked if she was okay.

Semmer then informed the victim that he needed to go back to his room and work on his resume, according to the complaint.

Based on the investigation, Semmer was arraigned at 10:45 a.m. on Monday, November 19, in front of Judge Quinn.
