Man Court Ordered to Report to Jail Faces Escape Charge

JEFFERSON CO., Pa. (EYT) — A man who was court ordered to report to the Jefferson County Jail is facing a felony escape charge after failing to arrive on the designated day.

Court documents indicate the Jefferson County Sheriff’s Department filed criminal charges against 34-year-old Joshua Toy, of Mayport.

According to a criminal complaint filed by Deputy Bickle, of the Jefferson County Sheriff’s Department, an arrest warrant for Joshua Toy was issued by Magisterial District Judge Gregory M. Bazyak, after Toy failed to report to the Jefferson County Jail as ordered by the Court, upon a conviction, to serve weekends beginning on Friday, November 19, 2018.

Toy’s failure to report was listed as an escapee, and the warrant was issued.

According to the complaint, Deputies Humes and Bickle traveled to the Toy’s address and found he was not at home. The deputies then learned that he was at work at a known business located in Oliver Township, Jefferson County. They responded to that location and spoke with HR personnel who advised that Toy was at work and said that he would bring Toy to the deputies.

The deputies waited in the office while Toy was retrieved. Upon Toy’s arrival, Deputy Bickle was able to identify him from a picture in the file. Toy was then placed him under arrest on the warrant.

According to the complaint, Toy stated that he had been in contact with Warden Elbel and had spoken with Judge Bazylak’s office regarding the warrant. Deputy Humes then contacted Judge Bazylak’s office to verify the status and was adviced to incarcerate him.

Toy was then taken into custody, transported to Jefferson County Jail, and incarcerated.

Based on the investigation, a third-degree felony charge was filed through Magisterial District Judge Gregory M. Bazyak’s office on Friday, January 11.

A preliminary hearing before is scheduled for 9:00 a.m. on Tuesday, March 5, with Judge Bazylak presiding.
