Men Involved in Violent Assault Outside New Bethlehem Bar Sentenced to Probation

CLARION, Pa. (EYT) — Two men were sentenced on Wednesday on charges related to a violent incident that occurred last year outside a New Bethlehem bar.

On Wednesday, April 10, President Judge James Arner sentenced 24-year-old Anthony Lynn Ortz, of New Bethlehem, and 24-year-old Braxton Richard Orr, of Strattanville, both to probation on charges in relation to a violent incident in New Bethlehem.

Arner ordered Ortz and Orr to one year of probation each on one second-degree misdemeanor count of conspiracy simple assault.

Both men are also required to complete 25 hours of community service.

Ortz and Orr each pleaded guilty to the charge on Wednesday, March 13.

As a result of the plea agreements, the following charges were dismissed:

  • Conspiracy — Aggravated Assault, Felony 1 (two counts)
  • Aggravated Assault, Felony 1 (two counts)
  • Conspiracy — Simple Assault, Misdemeanor 2
  • Simple Assault, Misdemeanor 2 (two counts)
  • Recklessly Endangering Another Person, Misdemeanor 2
  • Disorderly Conduct Engage in Fighting, Misdemeanor 3
  • Harassment — Subject Other to Physical Contact, Summary

The charges stem from an incident that occurred in March of 2018.

Details of the case:

Court documents indicate the New Bethlehem Borough Police Department filed criminal charges against 23-year-old Gary Dylan Rhodes, of Mayport; 23-year-old Anthony Lynn Ortz, of New Bethlehem; 23-year-old Braxton Richard Orr, of New Bethlehem; and 36-year-old Brent Allen Lee, of Fairmount City.

According to the criminal complaint, on Monday, March 19, 2018, Sergeant Nicole Peck was assigned to investigate an assault case. There was an altercation between the victim’s father (Franklin Davenport) and another individual inside a local bar at approximately 1:15 a.m, and the victim and Franklin Davenport were directed to leave the bar.

The complaint states that Gary Rhodes, Anthony Ortz, Braxton Orr, and Brent Lee then followed the victim into the bar’s parking lot and, acting in concert with each other, allegedly instigated an altercation with the victim and the victim’s father (Franklin Davenport). The victim was then struck on the head repeatedly and finally kicked in the face as he was attempting to get off the ground.

The victim required surgery to correct a fractured jaw; he suffered bruising, cuts, and redness on the top of the left eye, bleeding in the ears, and injuries around the mouth area.

Altercation Inside Bar

According to a criminal complaint, on March 19, New Bethlehem Borough Police Sergeant Nicole Peck was assigned an assault incident that occurred inside a New Bethlehem bar.

The complaint states that Franklin Davenport allegedly hit a known victim in the face area with a glass beer mug, causing injury.

The physical altercation allegedly started when the victim and Davenport’s son engaged in a verbal altercation.

Davenport and his son were then asked to leave the establishment, according to the complaint.

Related Cases

According to court documents, 24-year-old Gary Dylan Rhodes, of Mayport, was sentenced to two years of probation on one count of second-degree misdemeanor conspiracy simple assault on February 20, 2019.

Rhodes pleaded no contest to the above charge on February 1, 2019.

As a result of the plea agreement, the following charges were dismissed:

Court documents indicate 37-year-old Brent Allen Lee, of Fairmount City, entered into the Clarion County Accelerated Rehabilitative Disposition (ARD) program, under the supervision of Clarion County Adult Probation, on one count of third-degree misdemeanor simple assault-mutual consent fight on February 11.

As a result of the agreement, the following charges were dismissed:

  • Conspiracy — Simple Assault, Misdemeanor 2
  • Disorderly Conduct Engage in Fighting, Misdemeanor 3

Court documents indicate 56-year-old Franklin L. Davenport, of Lickingville, entered into the Clarion County Accelerated Rehabilitative Disposition (ARD) program, under the supervision of Clarion County Adult Probation, on one count of second-degree misdemeanor simple assault on October 31, 2018.

As a result of the agreement, one count of summary disorderly conduct-engage in fighting was dismissed.
