Local Man Accused of Grabbing Woman by Throat During Domestic Dispute Waives Hearing

JENKS TWP., Pa. (EYT) — A local man waived his preliminary hearing on Tuesday on charges related to a domestic incident where he allegedly grabbed a woman by the throat.

Court documents indicate the following charges against 42-year-old James Daniel Micale, of Marienville, were waived for court on Tuesday, October 1:

– Terroristic Threats With Intent To Terrorize Another, Misdemeanor 1
– Harassment — Subject Other to Physical Contact, Summary
– Simple Assault

The charges have been transferred to the Forest County Court of Common Pleas.

Micale is currently free on $2,500.00 unsecured bail.

The charges stem from an incident that occurred in Jenks Township on September 19.

According to a criminal complaint, around 11:53 p.m. on September 19, 2019, Troopers Salusky and Smith, of the Marienville-based State Police, responded to a report of possible domestic violence at a location on Oak Lane in Marienville, Jenks Township, Forest County.

According to the complaint, at the driveway of the location, officers met with a known female victim who reported that James Daniel Micale grabbed her throat with both of his hands during an argument inside the residence around 11:30 p.m. The victim complained of pain on the front and back of her neck. Trooper Salusky observed redness on her neck.

The troopers then entered the residence and called for Micale, but he did not respond. They located him in a back bedroom on a bed with his hands concealed. The troopers directed Micale to show his hands, but Micale refused. The troopers then physically restrained Micale and placed him in handcuffs for safety reasons and as part of an investigatory detention.

According to the complaint, Micale then admitted to arguing with the victim and placing his hands “on her shoulders near her collar bones,” but denied grabbing her by the neck/throat.

Based on the victim’s report and the injuries observed on the victim, Micale was then placed under arrest.

Micale was arraigned in front of Magisterial District Judge Todd A. Woodin at 9:45 a.m. on September 20.

Unable to post $2,500.00 monetary bail, he was lodged in the Warren County Jail.

He was released on Tuesday, October 1, after his bail type was changed to unsecured at the request of his defense attorney.
