CLARION, Pa. (EYT) – A Clarion man charged in connection with the drug-related death of a 26-year-old man in August was sentenced to probation on Wednesday.
Clarion County President Judge James Arner on Wednesday, November 20, sentenced 26-year-old Matthew Earl McDermid, of Clarion, to two years of probation on one second-degree misdemeanor count of reckless endangerment.
He was also ordered to complete a drug and alcohol treatment program and to perform 50 hours of community service.
McDermid pleaded guilty to the above charge on Wednesday, October 23.
As a result of the plea agreement, the following charges were dismissed:
- Conspiracy — Drug Delivery Resulting In Death, Felony 1
- Criminal Use Of Communication Facility, Felony 3
- Conspiracy — Manufacture, Delivery, or Possession, Felony With Intent to Manufacture or Deliver, Felony
- Conspiracy — Involuntary Manslaughter, Misdemeanor 1
- Intentional Possession Controlled Substance By Person Not Registered, Misdemeanor
- Use/Possession Of Drug Paraphernalia, Misdemeanor
The charges resulted from an investigation by the Clarion Borough Police and the Pittsburgh City Police Department.
Details of the case:
According to a criminal complaint, around 8:35 p.m. on August 15, 2018, the Clarion Borough Police were dispatched to a location on Merle Road for a male patient in cardiac arrest.
Officers arrived at the scene and located 26-year-old Tanner Eisenman, deceased on the living room floor. The officer located a syringe/needle laying on the floor beside Eisenman’s leg.
Clarion County Coroner Randall Stom was called to the scene and pronounced Eisenman deceased at the residence.
The needle and Eisenman’s cell phone were seized by the Clarion Borough Police as evidence.
Stom scheduled an autopsy for August 17 with Dr. Vey in Erie, Pa. During the autopsy, which was attended by Clarion Borough Police Detective Kemmer, two bundles of suspected heroin were inside Eisenman’s pants pocket. The stamp bags were marked “fat bitch,” according to the complaint. They were then submitted to the Erie Regional Crime Lab.
The complaint notes that the liquid from the syringe tested positive for fentanyl and the 21 white wax paper bags stamped “fat bitch” containing a white powder with a total net weight of less than one gram tested positive for heroin and fentanyl.
The autopsy report and the NMS Lab reports listed “combined drug toxicity involving Fentanyl compounds” as the cause of death, according to the complaint.
The Clarion Borough Police Department, with the assistance of the Pittsburgh City Police Department, conducted an investigation into Eisenman’s death.
The investigation revealed that Matthew McDermid drove Eisenman to the City of Pittsburgh on August 14, 2018.
Eisenman was found deceased the following day.
