Two Local Men Facing Multiple Charges in Burglary Gone Wrong

LIMESTONE TWP., Pa. (EYT) – Charges have been filed against two local men in connection with a December 12 break-in that lead to one of the alleged burglars being shot in the leg by the homeowner.

Timothy D. Stormer, 47, of Summerville, and Shane A. Bundy, 27, of Knoxdale, are facing multiple felony charges in connection with the following incident.

911 Call, Police Arrive on Scene

According to a Criminal Complaint filed at District Magistrate Jeffrey C. Miller’s Office, Clarion-based State Police received a 911 call on December 12 around 4:00 p.m. indicating that a male subject had been shot at the residence of 426 Kingsville Road, in Limestone Township, Clarion County.

The caller advised that two male subjects had broken into a house located at the above address. The caller also indicated that one of the men had been shot, and the other man fled the scene.

Upon police arrival, the burglary victim, identified as a 63-year-old man, was observed standing in the yard outside the residence, holding a silver/black semi-automatic pistol. The man who had been shot was found next to a blue van.

The weapon was secured at the scene. The wounded man was identified as 47-year-old Timothy Stormer. Emergency personnel transported him to Clarion Hospital for treatment of a gunshot wound to the right leg.

The scene was then secured. An attempt to locate the second man was unsuccessful at that time.

Interview with Victim

Upon arrival at the scene, Clarion-based State Police Trooper Rodney Hotchkiss conducted an interview with the victim. The victim, a 63-year-old man, related the following:

“The victim told police that he has been having problems of thefts from the house since Spring and has had numerous things taken from the house including an aluminum boat, wheel weights, barrel wood furnace, and numerous other things. He stated that the thefts usually occurred on weekends, but he has been staying in the barn for the last week trying to find out who’s been breaking into the house.”

“He told the officer the house currently didn’t have anyone living in it, but he ‘stores all kinds of stuff at the house and in the adjacent barns.’ He indicated that he was in the barn and around 4:00 p.m. heard a vehicle pull into the driveway of the house. He advised that he exited the barn and walked over to the house which is approximately 30 yards from the residence and saw a van in the driveway.”

“The victim said he looked around and didn’t see anyone around and glanced at his small garage next to the driveway and saw that the lock for the door was broken and laying on the ground. He related that the lock was cut earlier, and he just replaced it. He said he followed footprints in the snow to the back of his house and saw that the back door was open. He told the officer that the doors were all locked and secured. He stated he yelled inside, ‘you guys in there come out.,’ and yelled at least three times. He advised that he walked back to the van and heard noise over by the outside cellar door, walked over to the cellar entrance and the wood door/cover that was over the stairs flipped open, and two guys had a coal stove at the top of the stairs. He stated that he told them to stop and take that back down the stairs. He told the officer that they did take it back down. He indicated that he did have his pistol in his hands and had it along side his waist but never pointed it at them.”

“According to the victim, when they came back up from the basement, they closed the door, and he told them to go to the front of the house. He said that Stormer followed him to the front of the house, but Bundy ran to the back of the house. He stated while he was at the front of the house, Stormer kept trying to ‘get him and was moving toward him.’ He told the officer he kept yelling at him to stay back.”

“The victim related that all at once, Bundy came around the back side and threw a large sledgehammer at him that just missed his head. He stated he shot two shots from his gun into the woods to scare him. He said that Bundy came back out from the other side, and he wasn’t sure who threw the hubcaps at him but believes it was Stormer, and they almost hit him. He related that Bundy then came out front where he was with Stormer.”

“The victim said the two guys kept circling him and that Bundy kept trying to get over to where the sledgehammer was laying. He stated that he kept telling Bundy to leave it alone and go sit down and that the police were coming. According to the victim, one of the perpetrators kept trying to get in the van. He said he didn’t know if there was a gun or anything in it and told him to stay away.”

“The victim indicated the two started circling him again, and he was scared, so he backed up to keep them from getting behind him. He said he told them to write their names down on paper (which he had) for the police. He stated he threw the paper and pencil to the guy, and as he did, the guy dropped low and charged at him. He told the officer he jumped back and fired his gun. He said he didn’t intend to hit him, just scare him back.”

Bundy Flees Crime Scene

“According to the victim, after he fired a shot, Stormer went to the ground and grabbed his leg. He said Bundy picked him up and carried him to the van and set him down. The victim said that he told Bundy to run down to the neighbors and call for help. He told police that Bundy left and returned at least three to four times and that he kept telling him to go call for help. The victim stated that ‘the guy finally left and about 45 minutes later, a car came down the road, so he flagged it down and told the kid inside to call for help.'”

“According to the victim, while they were waiting for help, Stormer kept going after the sledgehammer and trying to get inside the van.”

Van Identified

“Police say a check of the van registration in the driveway indicated it was owned by Cindy Lou Legross, the wife of Stormer. The vehicle was towed from the scene by Leadbetter’s Towing Service and placed in the secured impound lot at the Clarion State Police Station.”

PSP Pittsburgh Interview Stormer at UPMC

“An interview with Stormer was conducted by PSP Pittsburgh at UPMC
Presbyterian. During the interview, Stormer identified Shane Bundy as the other actor in the incident.”

Legross Interviewed

“On December 13, Legross contacted the PSP Clarion via telephone to speak about
retrieving her van. Police requested an interview with Legross which occurred around 11:00 a.m. on December 14.”

“Legross told police that Stormer and Bundy ‘went junking’ that morning and that around 6:00 p.m., Shane returned to the house and told her that she needed to go get Stormer, that he had been shot and that she needed to get him before the police get there.'”

Bundy Arrested on Active Warrant

“Legross told police that Bundy was currently at her house. Based on the information provided by Legross and the fact that an active warrant was issued for Bundy for probation/parole, he was taken into custody and placed in the Jefferson County Jail.”

Stolen Items Transported to PSP Clarion

“During the interview, Legross admitted to police to helping Stormer take a boat from the victim’s residence and that Stormer has also taken other things. She said some were scrapped, and others were still at her house. Legross produced all of the items that she knew were taken from the victim’s residence, and the items were transported back to PSP Clarion station to be identified and returned to the victim.”

Charges Filed Against Stormer and Bundy

State Police subsequently filed charges against both men at Magisterial District Judge Jeffrey C. Miller’s Office in New Bethlehem.

The following charges were filed against Stormer:

– Burglary – Overnight Accommodation, Person Present (Felony 1)
– Conspiracy – Burglary – Overnight Accommodation, Person Present (Felony 1)
– Aggravated Assault (Felony 1)
– Criminal Trespass-Break Into Structure (Felony 2)
– Conspiracy – Criminal Trespass-Break Into Structure (Felony 2)
– 2 counts, Theft By Unlawful Taking-Movable Prop 12/12/2014 (Misdemeanor 1)
– Simple Assault (Misdemeanor 2)
– Recklessly Endangering Another Person (Misdemeanor 2)
– Conspiracy – Recklessly Endangering Another Person (Misdemeanor 2)
– Conspiracy – Simple Assault (Misdemeanor 2)

He faces a preliminary hearing before Judge Miller on December 30.

The following charges were filed against Bundy:

– Aggravated Assault (Felony 1)
– Burglary – Overnight Accommodation, Person Present (Felony 1)
– Conspiracy – Burglary – Overnight Accommodation, Person Present (Felony 1)
– Criminal Trespass-Break Into Structure (Felony 2)
– Conspiracy – Criminal Trespass-Break Into Structure (Felony 2)
– Flight To Avoid Apprehend/Trial/Punish (Felony 3)
– 2 counts, Theft By Unlawful Taking-Movable Property (Misdemeanor 1)
– Simple Assault (Misdemeanor 2)
– Recklessly Endangering Another Person (Misdemeanor 2)
– Conspiracy – Recklessly Endangering Another Person (Misdemeanor 2)

A preliminary hearing date has not been set for Bundy.
