NEW BETHLEHEM, Pa. (EYT) — A New Bethlehem man is facing charges after an incident outside of a New Bethlehem bar late Saturday night.

Court documents indicate the New Bethlehem Borough Police Department filed criminal charges against 44-year-old Tobias Wade Allen, of New Bethlehem.

According to a criminal complaint, around 10:12 p.m. on Saturday, March 31, Officer Bowser, of the New Bethlehem Police Department, was on patrol when he witnessed a man, later identified as Tobias Wade Allen, urinating outside a bar in New Bethlehem.

Officer Bowser backed up and pulled into the parking area, and Allen ran inside the bar. Officer Bowser followed him inside, identified him, and asked him to step outside. Officer Bowser then explained why he was contacting Allen.

According to the complaint, Allen allegedly became very offensive, stating he did not urinate outside and asked if Officer Bowser had “video proof” of the act. Officer Bowser said he did not have video footage, and Allen stated “without video proof, it is his word against the officer’s word, and said Officer Bowser could ‘[expletive] off.'”

Officer Bowser noted that Allen was visibly intoxicated, the complaint states.

Officer Bowser advised Allen that charges would be filed, but he was free to go.

On Monday, April 2, the following charges were filed in Magisterial District Judge Jeffrey C. Miller’s office:

– Open Lewdness, Misdemeanor 3
– Disorderly Conduct Hazardous/Physical Offense, Summary

A preliminary hearing is scheduled for 10:00 a.m. on Monday, April 23, in front of Judge Miller.
