Rimersburg Woman Faces Theft Charges

CLARION BOROUGH, Pa. (EYT) – A 31-year-old Rimersburg woman is facing criminal charges from an alleged theft that occurred last month in Clarion.

Court documents indicate the Clarion Borough Police Department filed criminal charges against 31-year-old Trisha Jean Davis, of Rimersburg.

According to a criminal complaint, around 2:25 p.m. on Friday, February 16, Officer Kemmer received a call from a residence on Liberty Street about a possible theft of Klonopin pills. The victim reported that she believes Trisha Jean Davis, may have been the person who had stolen the pills. The victim reported that she believes this occurred on Tuesday night, February 13. She stated that she noticed the pills missing on Wednesday, February 14, and the only person in and out of her apartment was Davis.

Around 1:00 p.m. on Tuesday, February 20, Officer Kemmer called Davis about the theft of the Klonopin pills. Davis admitted to working at the victim’s apartment on the day of the theft and also seeing the pill bottle sitting on the victim’s table. Davis stated she even remembers telling the victim that she needs to remember to take her pills before going to bed. Davis stated that her shift ended and she left the victim’s apartment. Davis then stated that on Thursday, February 15, she returned to the victim’s apartment, and when she arrived, the victim asked her if she had seen her pill bottle. Davis stated that she told the victim that the last time she had seen the pills they were sitting on her table on the night of February 13, right before she left. Davis then stated that she did not take the victim’s pills and that she is willing to take a drug test to prove that she does not do any type of drugs.

On Thursday, February 15, Officer Kemmer received a call from Chief Peck who reported that he received a call from an employee of the Clarion County Agency on Aging. Chief Peck said he was told that the victim is now reporting that someone had stolen four $25.00 gift cards from her apartment. The agency employee has copies of the receipts which have the gift cards’ number on them. The employee had tracked where the gift cards had been used, and two of the transactions occurred at Walmart in Clarion. One transaction occurred on January 9, at 7:24 p.m. and the other occurred on January 11, at 1:03 p.m. Chief Peck had already contacted Walmart, and they were looking at the store video and would contact police if they found anything.

After speaking with Chief Peck, Officer Kemmer drove to the victim’s apartment and spoke with her about the theft. The victim stated that around the time of the end of November 2017 or the beginning of December 2017 she had purchased four $25.00 gift cards to give to grandchildren for Christmas. She said that right before Christmas, she was hospitalized where she remained until the beginning of January. She stated that after getting out of the hospital, her family was going to have a late Christmas party, and when she went to look for the gift cards, they were gone. The victim stated that she looked for the gift cards for several days and believed she misplaced the cards. Then, she said that since she is now missing her Klonopin pills, she believes that Davis may have stolen the cards. Officer Kemmer asked her when Davis started to work with her in her apartment, and she said at the beginning of January, right after she was released from the hospital.

After leaving the apartment, Officer Kemmer drove to Walmart and was given copies of the Walmart gift card transactions along with video footage. He reviewed the transactions and found the first transaction occurred on January 9, at 7:24 p.m. in the amount of $45.90. The second transaction occurred on January 11 at 1:03 p.m. in the amount of $29.85. Both transactions were on the victim’s gift cards, which she had purchased. After looking at the transaction, Officer Kemmer watched the video and found that the same person had made the two transactions, and that person was Trisha Davis.

Around 8:05 am. on February 23, Davis arrived at the station for another interview. Officer Kemmer read Davis her rights, and she agreed to speak with him about the theft. He asked Davis about the theft of the victim’s Klonopin pills. Davis again stated that she did not take the victim’s pills. After a short conversation about the pills, he asked Davis about the theft of the gift cards. At first, Davis stated that she did not take the gift cards. Officer Kemmer then confronted Davis about the video and the transactions he received from Walmart. Davis then admitted to taking the gift cards from the victim’s apartment and using them. Davis also later admitted to taking two $25.00 Applebee’s gift cards from the victim and using them, as well. Davis said she is willing to give the victim back her $150.00, according to the complaint.

Based on the investigation, the following charges were filed against Davis:

– Theft By Unlawful Taking-Movable Property, Misdemeanor 2
– Receiving Stolen Property, Misdemeanor 2

A preliminary arraignment is scheduled for 9:45 a.m. on Monday, March 12, at the office of Magisterial District Judge Duane L. Quinn.
