CLARION, Pa. (EYT) — Two local residents who were involved in hindering the apprehension of a fugitive earlier this year are scheduled to be sentenced on Wednesday.
According to court documents, 25-year-old Kirsten Renee Wolff, of Strattanville, and 23-year-old Cody Lee McGinnis, of Clarion, scheduled to be sentenced by Clarion County President Judge James G. Arner at 9:00 a.m. on Wednesday, November 28.
They each pleaded guilty to one second-degree misdemeanor count of hindering apprehension — false information to law enforcement on Wednesday, October 31.
As a result of the plea deals, the following charges were dismissed against each Wolff and McGinnis:
– Hinder Apprehension/Prosecution-Harbor Or Conceal, Misdemeanor 2
– Hinder Apprehension/Prosecution-Provide Aid, Misdemeanor 2
Wolff and McGinnis both remain free on bail.
Details of the case:
According to a criminal complaint, around 2:20 p.m. on April 10, 2018, four Clarion County probation officers went to 1117 Staab Road, Lot 55, in Clarion Township to serve a warrant on Damean Michael Felmlee. Felmlee was an absconder from probation, and a warrant for his arrest was issued by Clarion County Probation on March 23, 2018.
Probation Officers Mosley and Kerle initially went to the door on the west side of the trailer while PO Hopkins went to the north side of the trailer and Deputy Director Blum went to the east side of the residence.
A female identified as Kirsten Renee Wolff came to the door. PO Mosley related they were looking for Damean Felmlee. Wolff stated that she did not know who that was. Wolff stated she just got home from work, and there was no one else at the residence. At that time, PO Hopkins yelled from the north end of the residence that she could see Felmlee through the window. PO Mosley started towards the north end of the residence, and PO Kerle remained at the porch area with Wolff. PO Kerle told her that there was a warrant for Felmlee and that he was in her residence.
The complaint states that DD Blum went to the east side of the trailer and PO Kerle entered the west entrance. As soon as PO Kerle entered the trailer, a strong smell of marijuana was noticed. PO Kerle went to the north end of the residence and did not encounter anyone. The door at the northeast end of the residence was open. As PO Kerle exited the residence, DD Blum was running towards a wooded area and yelled that Felmlee fled on foot. PO Kerle then went to his probation vehicle and went south on Staab Road searching for Felmlee and contacted Clarion County OES to request assistance. The Clarion County Sheriff’s Department and PSP Clarion responded and assisted in the search for Felmlee.
A PSP search helicopter was called to assist and nine troopers responded to search the area where Felmlee fled. Felmlee was not taken into custody during the search.
The complaint states that Felmlee received assistance in fleeing from probation officers as they were delayed by Wolff during the initial contact with probation. Additionally, Wolff was witnessed in and around the search area with her vehicle as the search was being conducted. Wolff was contacted and a fresh set of male clothing (including a gray hoodie and Timberland boots) was witnessed in the rear seat of her vehicle.
On April 11 at 4:30 p.m. a traffic stop was initiated on a vehicle on North School Street in Shippenville Borough for an unlit right headlight. The subject vehicle was a Silver Toyota Solara. Upon approaching the vehicle, the driver was identified as Kirsten Renee Wolff. A strong odor of marijuana was emanating from the vehicle. A probable cause search of the vehicle was conducted, and a brown leather wallet with Damean Michael Felmlee’s PA ID and two VISA Skylight cards were located inside Wolff’s purse. Wolff related that she found the wallet in her residence after the incident the previous day and was going to return it to Felmlee’s grandparents. Wolff stated that she knew Damean Felmlee as Damean Black and did not know where he was at the present time.
According to court documents, Felmlee was sentenced to six months to two years less one day of confinement, with credit for 167 days served, on Wednesday, October 31, after pleading guilty to one third-degree felony count of flight to avoid apprehension. He remains lodged in the Clarion County Jail.
