Hearing Set for Man Accused of Choking Woman During Domestic Dispute in Washington Township

CLARION CO., Pa. (EYT) – A hearing has been scheduled for a man who allegedly forced a woman to the ground and choked her during a domestic dispute in Washington Township.

According to court documents, a preliminary hearing for 25-year-old Derek Scott Overly, of Boyers, Butler Co., is scheduled for October 29 at 8:30 a.m. in front Magisterial District Judge Timothy P. Schill on the following charges:

– Simple Assault, Misdemeanor 2
– Use/Possession of Drug Paraphernalia, Misdemeanor
– Harassment – Subject Other to Physical Contact, Summary (two counts)

The hearing was originally scheduled for August 6; however, it was continued to October 29.

Overly is currently free on $2,500.00 unsecured bail.

The charges stem from an incident that occurred at a parking lot on Lake Lucy Road, in Washington Township, Clarion County, on June 20, 2019.

Details of the case:

According to a criminal complaint filed on June 20 by Trooper Smith, of the Marienville-based State Police, around 11:58 a.m. on Thursday, June 20, he was dispatched to the above-described location for a report of an active domestic dispute between a male and a female.

Upon his arrival, Trooper Smith made contact with Derek Overly and a known female who were allegedly screaming at each other at that time. Trooper Smith separated the pair and first interviewed the female victim.

The complaint notes that Trooper Smith observed physical injuries to the victim’s neck, leg, and both elbows.

According to the complaint, both Overly and the victim stated the argument began at a nearby residence, and Overly left the residence with his personal effects, but a short time later, both parties engaged in a verbal argument a second time, during which time the victim grabbed Overly by the arm in an effort to “talk things out.”

The victim reported that Overly then forced her to the ground (in the gravel parking lot) where she suffered an injury to her right knee and elbows. The victim then walked away, and Overly followed, demanding the return of his backpack, the complaint states.

Overly then grabbed the string of the backpack, and a second physical altercation ensued. The victim landed on the ground (in a lawn area), and Overly then grabbed her by the throat while she was lying face-down on the ground, according to the complaint.

The victim had a visible injury to her throat and neck area that was consistent with being grabbed around the neck. Trooper Smith also observed the victim had abrasions and dirt on her left arm and elbow, the complaint indicates.

During a search prior to the transport of Overly’s personal effects, numerous items of drug-related paraphernalia and several knives were discovered in the bag that Overly admitted belonged to him, the complaint states.

Overly was arraigned in front of Judge Schill at 3:15 p.m. on Thursday, June 20.
